1. Preamble
I, the data subject (hereinafter — the User), freely, of my own volition, and in my own interest, hereby give my consent to Boya Hospital (hereinafter — the Operator), located at No. 346, South Jiefang Road, Yanhu District, Yuncheng, Shanxi Province, China, to process my personal data on the following terms.
This consent is given in accordance with the Personal Information Protection Law of the People's Republic of China (PIPL), Federal Law of the Russian Federation No. 152-FZ 'On Personal Data', and generally accepted international data protection standards, including Regulation (EU) 2016/679 (GDPR) — to the extent applicable to the processing of data of citizens of the respective jurisdictions.
2. Categories of Personal Data
This consent applies to the processing of the following categories of personal data:
- Full name (including patronymic, if any)
- Contact phone number
- Email address
- Information about the child's diagnosis (classified as a special category of personal data — health data)
3. Processing Purposes
Personal data is processed for the following purposes:
- Booking consultations and appointments with the clinic's specialists
- Contacting the User to provide information about services, appointments, and results
- Providing medical rehabilitation services
- Statistical analysis of inquiries in order to improve service quality
4. Processing Methods
The Operator processes personal data by the following methods: collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (provision, access), anonymization, blocking, deletion, and destruction of personal data. Processing may be carried out with or without the use of automated means.
5. Consent Duration
This consent is effective from the moment it is given until it is withdrawn, but for no less than 3 (three) years from the date of the User's last interaction with the Operator.
Upon expiry of the specified period, in the absence of any interaction, the consent terminates automatically and the personal data is subject to destruction or anonymization.
6. Consent Withdrawal Procedure
The User has the right to withdraw this consent at any time by sending a written request to the Operator's email address or to the clinic's postal address.
The Operator is obliged to cease processing the personal data and ensure its destruction within no more than 30 (thirty) business days from the date of receipt of the withdrawal request.
Withdrawal of consent does not affect the lawfulness of processing carried out prior to the withdrawal. The Operator may continue processing the data where other legal grounds provided for by applicable law exist.
7. Special Consent for Medical Data Processing
Information about the child's diagnosis constitutes a special category of personal data (health data). By providing this data, the User gives explicit and informed consent to its processing solely for the purpose of providing medical rehabilitation services.
In accordance with the legislation of the People's Republic of China on personal information protection, the processing of sensitive personal data is permitted where the data subject has given separate informed consent.
In accordance with Article 10 of Federal Law No. 152-FZ, the processing of special categories of personal data is permitted where the data subject has given consent in writing.
In accordance with Article 9(2)(a) GDPR, the processing of health data is permitted where the data subject has given explicit consent to the processing for one or more specified purposes.
The Operator ensures compliance with medical confidentiality and the privacy of medical information in accordance with the legislation of the People's Republic of China.
